With a convincing 6-3 lead, the US Supreme Court blocked the Biden administration’s compulsory vaccination mandate.
THE MANDATE WOULD BE FROM OSHA. HAVE BEEN ENFORCED
The Office for Occupational Health and Safety would have overseen the mandate, but it is now blocked. Washington is one of the states where our work and industry is “overseen” or subcontracted, essentially run by OSHA (the Fed).
This ban does not apply to federal employees, but only to employees in private companies. It does not apply to government employees of WA or its subcontractors, only to private companies.
The mandate had tried to encircle essentially all of US industry and was for private companies with 100 or more employees. Now it’s locked.
WILL THIS MANDATORY TEST BE REMOVED?
Many companies have been willing to offer their workers a testing option, but with the Vax mandate going away, it doesn’t seem necessary.
The blockade is one of the biggest blows to the Biden government since taking office in January.
The court upheld the mandate for medical personnel, the Centers for Medicare and Medicaid Services, with 5-4 points.
Breitbart.com reports that the court is “skeptical” of the OSHA mandate, including the difficulty federal officials have in determining the legal authority to impose such a mandate.
WHAT DOES THIS MEAN FOR WASHINGTON STATE?
The state was ready to take over the Labor and Industry mandate (through OSHA) and was eager to pursue it. But now that the mandate is on Supreme Court level, There won’t be much that Attorney General Bob Ferguson can do. The state could potentially enact one, but with the Supreme Court blocked it could lead to a massive legal battle over it. We will see.
